This Housing Contract (the “Contract”) is by and between The Trustees of Indiana University on behalf of its Capital Campus (“Capital Campus” or “University”), the Capital Campus Office, and you, the student (Resident). If you are under 18 years of age, this Contract will not be effective unless your parent or guardian agrees to its terms by electronically submitting a signed copy of the Contract.
The Capital Campus has two main configurations of living quarters, single and double, on two floors. All have a shared common space, kitchenette, and individual bath facilities. Sleeping areas may be single or double occupancy. For purposes of this Contract, the term “floor” shall refer to all common areas and the Resident’s sleeping area, irrespective of whether the Resident has a roommate in the sleeping area. “Room assignment,” as used in Section E, shall refer to a double or single sleeping areas.
The following students are eligible for Capital Campus housing, and applications will be prioritized as follows. a. IU students participating in an IU program (for-credit courses) taking place in Washington D.C. b. IU students participating in University-related activity (for-credit/non-credit experiential trip) taking place in Washington, D.C.
Failure to enroll, or loss of student status based on University suspension or expulsion, will result in the loss of eligibility for Capital Campus housing. Upon notice of loss of eligibility, the Resident agrees to vacate the floor within one (1) calendar day. The Resident’s remaining financial obligations are set forth in Section B.
Convicted sexual offenders are not eligible to reside in University housing. If the Capital Campus Office learns that an applicant for housing is a convicted sex offender, the application will be rejected. If the Capital Campus Office learns that a current student is a convicted sex offender, this Contract will be cancelled in accordance with Section K.
This Contract becomes effective upon the Capital Campus Office’s receipt of this signed Contract, and if applicable, the required payment identified below. The term of the Contract is for either the academic year or spring semester only, as indicated on the Resident’s application for housing, which is incorporated into this Contract by reference, and as indicated in Section J below.
Except as provided in Section J, a Resident who vacates the housing assignment during the Contract period and who remains enrolled as a student at Indiana University remains obligated to pay the balance of the Contract amount.
The University will provide the Resident with a furnished room and access to common areas, bathrooms, kitchenette on their assigned floor.
If the Resident is participating in a year-long IU program/activity, the Resident may remain in Capital Campus housing during the recess period of fall-to-spring semester break if the Resident has registered with the Capital Campus Office at least ten days prior to the end of the fall semester. The Resident may leave personal belongings in the room during this recess period. The University reserves the right to require Residents to vacate during this fall-to-spring semester recess period, including without limitation for health or safety reasons, and/or to seek approval to remain on campus (see paragraph 3 below).
If the University implements any intersession period(s) during the 2025-26 academic year, IU may require Residents to seek approval to remain on campus. Residents who receive approval to remain on campus during any such intersession period will be charged the University approved housing rate for the respective semester. If the University requires Residents to vacate during any other recess or break period, including winter break and spring break, Residents may be required to seek approval to remain on Capital Campus. Residents who receive approval to remain on campus during any such period may be charged the weekly rate for each room type, as determined by the University and at its sole discretion. The Resident will be charged this rate through a separate billing process. Guidance on the petition process, including the deadline and associated fee information, will be made available on the Capital Campus Office website.
If approval to remain on campus is required pursuant to any of the above situations, Resident must submit a petition online at least 10 days prior to that date. The petition must be approved to remain in Resident's housing assignment, and such approval is at the sole discretion of the University. Failure to submit the petition online within this timeframe may result in denial of Resident's petition. The Capital Campus Office reserves the right to temporarily change Resident's housing assignment during any intersession other break period.
The University agrees to provide reasonable amounts of heat, water, and electricity. Interruptions on a temporary basis for reasons of maintenance, repair, or catastrophe will not be considered a breach of this contract, and the University assumed no responsibility for damages incurred by a Resident during such an interruption, including but not limited to food spoilage. The University will restore the affected service as soon as reasonably possible.
No housing application fee is required with this application and Contract in order to be processed.
The Capital Campus Office will preliminarily assign you to a room based on the date of the Capital Campus Office’s receipt of your housing Contract, and when possible, in accordance with your requests for room type, and/or roommate. The inability of the Capital Campus Office to honor your housing preferences shall not constitute a breach of this Contract. A specific room assignment based upon your preference or requests is not guaranteed or implied.
If the Capital Campus Office is unable to deliver possession of the room preliminarily assigned, you agree to accept assignment to another room type. An assignment change shall not constitute a breach of this Contract.
Room assignments are subject to change at any time. The Capital Campus Office reserves the right to change your assignment in appropriate circumstances, including, but not limited to American with Disabilities (ADA) compliance, disciplinary reasons, catastrophe, renovation or closing of part or all of the facility, consolidation of vacancies, or irresolvable incompatibility of roommates. Reassignment pursuant to this paragraph is not a disciplinary action and does not constitute termination or breach of this Contract.
Residents who wish to be roommates or floor-mates are encouraged to submit their Contracts together. Only mutual requests will be considered.
Assignments are made without regard to race, sexual orientation, religion, or national origin. Any request for a change of assignment based on these reasons will be rejected.
The Resident agrees to observe the room change procedures established by the University and to have a prior written approval from the Capital Campus Office before making a room change.
If a vacancy occurs in the assigned room or floor, the remaining Resident(s) agree(s) to: accept another roommate assigned, move to another room if requested by the Capital Campus Office, or accept it as a private room. If there is no waiting list for Capital Campus housing, the Resident may elect to keep the room as a private room upon payment of the difference in rate between a double and private room.
If applications for housing exceed the number of available spaces, the University reserves the right to assign temporary spaces, including triples, pending assignment to a permanent space. Any temporary assignments will be made solely at the discretion of the University.
Residents are required to comply with health and safety laws, orders, ordinances, regulations, and health and safety guidance adopted by IU and the Capital Campus Office as they relate to public health or safety crises. Adherence to health and safety requirements applies to all Residents, staff, and visitors and extends to all aspects of residential life, including bedrooms, bathrooms, community kitchens, lounges, computer labs, courtyards, and other common spaces.
The Capital Campus Student Handbook has been updated to specifically include a section related to COVID-19 and is incorporated by reference into your Housing Contract (see Housing Contract Section K.1.). The terms are designed to protect the health and safety of our students and minimize the potential spread of viruses within our community.
Your assigned room shall be occupied by only you and other assigned resident. A Resident may not sublease or rent a room assignment or permit another person to share a private room assignment. Any attempt to do so is considered a breach of contract and will result in expulsion from University housing. Occupancy for more than two (2) consecutive days, or more than 3 nights total in any 30 day period, by any other person shall constitute a breach of this Contract unless prior written consent is obtained from the Capital Campus Office.
If you are required to self-quarantine or self-isolate, or if the University needs to de-densify the room or floor to which you are assigned, you agree to relocate to alternative housing (including housing that may be off-campus) identified by the University. Residents are required to comply with requests from the Capital Campus Office to leave their assigned room due to COVID-19 or other public health emergency. Failure to do so may subject a Resident to emergency removal from their assigned room and/or cancellation of their housing contract. Removal from Capital Campus Housing, or temporary assignment to alternative housing, to isolate or quarantine does not constitute a termination of a Resident’s Housing Contract.
You are responsible for keeping your room sanitary and safe. You agree to report any deteriorated conditions or maintenance needs of your room or its furnishings to the Capital Campus Office. You agree to pay for damaged or missing furnishings and damages to the room caused by you, your visitors, or guests.
When you vacate your room, you agree to return the furniture to its original position; to leave the room in a clean, orderly condition, reasonable wear and tear excepted; and to follow published check out procedures.
You shall not remove any furniture located in the common areas, study lounges, computer labs, or other common spaces in Capital Campus housing (“Common Furnishings”). If Common Furnishings are found in a Resident’s room, the Resident will be subject to disciplinary action.
You shall not move any furnishings out of the room. Furnishings may not be stored anywhere else other than the room.
You shall not modify, or allow the modification of, the assigned room or other parts of the floor. Constructing structures such as lofting systems is not allowed.
You agree to pay charges assessed on a pro-rated basis for damages to the common areas of the floor that cannot be attributed to a single responsible party.
You agree to use public areas in a way that contributes to the orderliness and cleanliness of all areas used by Residents and guests.
The Capital Campus reserves the right to enter your room according to the procedures set forth in the Capital Campus Housing Handbook at [link] for law enforcement purposes, as well as for custodial services, health and safety inspections, room repair and maintenance, pest control, and emergency situations. In general, in non-law enforcement and non-emergency situations, twenty-four (24) hour notice will be given prior to entry.
You agree to vacate the room at the end of your Contract. You agree to vacate the room within three (3) calendar days of losing eligibility for housing, cancellation fees apply. In exigent circumstances, you may be directed to vacate immediately, and you agree to do so. You also agree to pay additional charges for rent accrued for any period that you hold over and for any damages or cleaning charges that are assessed.
You agree to pay all reasonable costs and expenses, including attorney’s fees, court filing fees, collection agency fees, etc., incurred by Capital Campus in enforcing this Contract.
Capital Campus may, at its option, cancel this Contract or seek legal remedy without further notice to you, if you abandon your room, fail to pay rent when due, or fail to rectify any default within ten (10) days after written notice of the default by the Capital Campus Office.
The failure of the Capital Campus Office to exercise its options under this Contract does not constitute a waiver or relieve you from your remaining obligations and duties under this Contract.
Housing fees shall be charged by the semester.
You agree to pay each semester’s housing fee by the due date established by the Bursar’s Office of your campus of enrollment (available on the Bursar’s Office website) or to have arranged a payment plan with the Bursar’s Office of your campus of enrollment prior to the first day of classes.
You agree that failure to make payment as prescribed does not relieve you of accumulated housing fees. You understand that nonpayment will result in expulsion from University housing. In addition, you will not be allowed to register for classes until the amounts due are paid.
The term of this Contract begins on the date you move in for early arrival, or from August 20, 2026 through May 8, 2027, or the "Cancellation Date" (defined below). Prorated charges for early arrival will be assessed. IU reserves the ability to modify the date on which you: (1) can arrange for early arrival; (2) move-in to your assigned room, including after any intersession or winter break period if Residents are required to vacate during that time (collectively, "Move-In"); and/or (3) move-out of your assigned unit, based on health or safety considerations, including, but not limited to, those related to COVID-19. In the event that Residents have the opportunity to select a time and date for Move-In, which dates and times will be set solely by IU, housing costs and fees will not be prorated or otherwise refunded based on the selected date of a Resident's move-in, nor will housing costs and fees be prorated or otherwise refunded due to any modification pursuant to this paragraph, or due to any revision of the University's academic calendar.
If your Contract is cancelled by the Capital Campus Office pursuant to Section J, or if your Contract is canceled because you become ineligible for university housing during the term of the Contract, you will be charged a cancellation fee which will be calculated according to Section J.
The University may choose not to refund any portion of the housing fees paid if the Resident is required to vacate or relocate pursuant to any emergency, national crisis, natural disaster, or other catastrophic event ("Exigent Circumstances"), and the University determines that the Resident received the substantial benefit of this agreement. Exigent Circumstances include, but are not limited to, University decisions related to community health and safety, including those related to COVID-19 or other public health or safety emergencies. These determinations will be made by the University in its sole discretion.
Cancellation Date means: a. The date you turn in your room key(s) and complete the published checkout process. b. If you never occupy or if you vacate your room and do not notify the Capital Campus Office in writing, or if you vacate and do not complete the published checkout process, the Cancellation Date is the day the Capital Campus Office learns that your assigned room is vacant.
For Contracts beginning August 20, 2026 through May 8, 2027: a. If your written request to cancel is received by July 31, 2026, there will be no cancellation fee. b. if your written request to cancel is received between August 1, 2026 through August 20, 2026, you will not receive a refund or credit, and assessed a cancellation fee of $XXXX.
For Contracts beginning January 7, 2027 through May 8, 2027: a.If your written request to cancel is received between October 1, 2026 through December 18, 2026, there will be no cancellation fee. b. f your written request to cancel is received after January 1, 2027, you will not receive a refund or credit, and assessed a cancellation fee of $XXXX.
Cancellation on or after the starting date of the Contract a. In the event you must medically withdraw from the University for reasons related to COVID-19 infection, the Capital Campus Office agrees to waive any breakage fee associated with terminating the Contract early, so long as IU's medical withdrawal process is completed and approved. b.If you are not an enrolled student on the Cancellation Date and do not subsequently enroll, you will be charged a $XXXX cancellation fee. c. If you are an enrolled student on the Cancellation Date, and subsequently remain and enrolled student, you will be charged rental through the Cancellation Date plus the $XXXX cancellation fee. d. Upon determination that you are no longer eligible to be enrolled based on either an academic dismissal or failure to pay amounts owed on your bursar bill, you will be charged for room rental plus the associated operational costs through the Cancellation Date. e. If you are dismissed from campus housing for disciplinary reasons, you will be charged rental through the Cancellation Date plus one hundred (100%) of the remaining balance of the Contract. f. This Contract shall terminate automatically if you are expelled from the University, and you shall vacate your room immediately. You will be charged rental through the Cancellation Date plus one hundred (100%) of the remaining balance of the Contract. g. If you voluntarily withdraw from the University you will be charged rental through the Cancellation Date plus the $XXXX cancellation fee.
You agree to familiarize yourself with and comply with all rules and expectations for conduct set forth in the Code of Student Rights, Responsibilities and Conduct at Code of Student Rights, Responsibilities, & Conduct: Indiana University and the Capital Campus Housing Handbook at [link will be provided]. Violations may result in administrative assignment changes pursuant to Section E of this Contract, eviction proceedings, Contract cancellation, and/or disciplinary action taken by the Capital Campus Office.
The Capital Campus Office reserves the right to make temporary administrative reassignment to another room if it is believed that you pose an imminent threat of physical or emotional harm to an individual, physical harm to property, or a significant threat to the stability of the community. This temporary administrative reassignment will be made pending referral to the campus of enrollment student conduct system for appropriate action, which could result in your return to the original assignment, permanent reassignment, or cancellation of your Contract.
The Capital Campus Office reserves the right to cancel your Contract and require you to leave University housing when you have exhibited behaviors that significantly disrupt the life of the residential community or pose a serious risk to any resident (including staff), student, staff, faculty member, or visitor. Depending on the circumstances, the conduct underlying the University’s decision to cancel this Contract may also be referred to campus of enrollment student conduct system for appropriate action.
You agree to pay charges as provided in Section J of this Contract if you are dismissed from Capital Campus for disciplinary reasons or if the Capital Campus Office cancels this Contract based on a violation of the Contract’s terms.
You are responsible for your own actions and the actions of your guests while on university property. This Contract may be terminated if you or your guests violate contract provisions, federal law, university polices, or Capital Campus policies.
The university does not assume responsibility for the loss of money or valuables belonging to the resident or third parties or for the loss or damage to personal property. It is recommended that you maintain adequate public liability insurance coverage and renter’s insurance coverage for your personal property.
Personal property remaining in the room after you vacate or abandon the room will be considered abandoned property and disposed of by the Capital Campus Office. You will be billed for any cost associated with such disposal.
The University does not provide storage for personal belongings.
You understand that by residing in Capital Campus housing, you are assuming the risks associated with communal living and, as in any shared living environment, those risks include potential exposure to contagious viruses, including COVID-19. You agree to release and fully discharge the Trustees of Indiana University, its agents, and employees from any and all damages, liability, claims, expenses (including attorney’s fees), or losses (collectively, “Claims”) related in any way to your use of space within Capital Campus Housing, including those related to the potential or actual exposure to contagious viruses like COVID-19, and to indemnify and hold harmless the University, its agents, and employees from any Claims related in any way to your breach of the terms and conditions of your Contract, or a breach by any third party, including, but not limited to other residents, of an applicable housing contract.
If this housing Contract is accepted and you are assigned to campus housing, you agree to abide by the terms of this Contract and all the rules and regulations of Indiana University Capital Campus. You understand that failure to comply with these rules and regulations may result in your separation from Capital Campus housing.
